A Miami-Dade judge on Tuesday allowed Cleveland Browns receiver Donte' Stallworth -- convicted of DUI manslaughter in June -- to leave his house to continue strength and conditioning training in preparation for a return to the playing field.
Stallworth served 24 days in jail after pleading guilty in June to driving drunk. He hit and killed a pedestrian on March 14 on the MacArthur Causeway. Under his plea deal, he must spend two years on house arrest and another eight on probation.
Stallworth was suspended indefinitely by the NFL but met recently with the league to inquire about returning. Defense attorney Christopher Lyons asked Circuit Judge Dennis Murphy to allow Stallworth to leave his Miami house to continue working with a trainer in Weston.
``As part of being a professional athlete, [he] must maintain an elevated degree of physical conditioning,'' the motion states.
Murphy granted the motion over the objection of prosecutor Pat Trese, who said Stallworth shouldn't be allowed out of his house because he was not actually earning money due to his suspension.
